Building a Fence, Driveway, or Accessory Structure
A zoning certificate is required when a building permit is not needed. A building permit may be required under specific circumstances; staff will refer you to the Building Permit team as required.
In some instances, a zoning certificate may not be required. If you are unsure, ask ZONINGDSC@norfolk.gov and they will assist in screening your request.
Once you submit your documents, please allow 5-10 business days for review. The zoning certificate and initial inspection are both free.
When issued via email, your zoning certificate will contain instructions on how to schedule your final inspection. This needs to be completed within 6 months or it will expire.
Items Needed for Driveway Zoning Certificate
Step 1: Submit the following to ZoningDSC@norfolk.gov for a driveway ZONING certificate. ***A review cannot be completed until the materials are submitted.***
- Completed Zoning Certificate application
- Proposal sketched on a survey or aerial photograph/ imagery. Include
- measurements (in feet) of the existing and new work
- distance to nearby property lines
- material to be used (gravel or loose rock not allowed)
Step 2: AFTER Zoning Certificate is issued, continue with the Department of Right-of-way to clear if they will also require a ROW driveway apron permit. This is a different permit than the driveway zoning certificate. There will be instructions on how to contact ROW in the email you receive with your driveway zoning certificate. (Questions? Items Needed for Fence Zoning Certificate
Submit the following to ZoningDSC@norfolk.gov for a fence ZONING Certificate. ***A review cannot be completed until the materials are submitted.***
- Completed Zoning Certificate application
- Proposal sketched on a survey or aerial photograph/ imagery. Include measurements (in feet) of
- the fence height
- distance to property lines
- description of the fence transparency (chain link, alternating pickets, privacy/solid, etc.)
- if installing gates, indicate height, transparency, and the direction they open
- Pool barrier fence- requires a building permit.
- Retaining wall- please start with a Building Permit. Should the Building Permits team determine that a Zoning Permit is sufficient, they will redirect you to the Zoning Team.
Items Needed for Accessory Structure Zoning Certificate (Shed, Patio, Pergola, etc.)
A ZONING CERTIFICATE CAN ONLY BE ISSUED FOR STRUCTURES 256 SQFT OR SMALLER. If the structure exceeds 256sqft, it will require a building permit.
Submit the following to ZoningDSC@norfolk.gov for an accessory structure ZONING CERTIFICATE. ***A review cannot be completed until the materials are submitted.***
- Completed Zoning Certificate application
- Proposal sketched on a survey or aerial photograph/ imagery. Include measurements (in feet) of
- dimensions of length, width, and height
- distance to property lines
- description of the structure (shed, pergola, greenhouse, etc.)
If the structure is in a flood zone or environmental, there may be additional structure specifications required; staff will alert you if so.
Building Permits
- Some projects require a building permit instead of a zoning certificate. If you have been directed towards a Building Permit, you will need to reach out to the building permit team. Please review the Building Permit pages below.
- Please visit the building permitting portal.
- You will need to create a project in the Permit Portal, complete the permit application, and upload all information and documentation via the portal.
- For discrepancies or clarification in your application, we will reach out via email.
- Once the site plan and construction plans are approved, we will notify you and request payment.

Permit Exemption Language
- 2018 Virginia Section 108 – APPLICATION FOR PERMIT
- 108.2 Exemptions from application for permit
- 5. Fences of any height unless required for pedestrian safety as provided for by Section 3306, or used for the barrier for a swimming pool.
- 6. Concrete or masonry walls, provided such walls do not exceed six (6) feet in height above the finished grade. Ornamental column caps shall not be considered to contribute to the height of the wall and shall be permitted to extend above the six feet height measurement.
- 7. Retaining walls supporting less than three (3) feet of unbalanced fill that are not constructed for the purpose of impounding Class I, II or III-A liquids or supporting a surcharge other than ordinary unbalanced fill.
