ACTION OF THE COUNCIL

 

TUESDAY, APRIL 7, 2009 – 7:00 P.M.

 

Prayer offered by Pastor Ken Gerry of New Life Christian Center, followed by the Pledge of Allegiance.

 

President Fraim moved to dispense with the reading of the minutes of the previous meeting.

 

Motion adopted.

CEREMONIAL MATTERS

 

1.      Mayor Fraim read a proclamation proclaiming the month of April as Child Abuse Prevention Month. The proclamation was accepted by Betty Wade Coyle.

 

2.      Mayor Fraim presented a proclamation to Naomi Mitchell, the youngest African American to win the U.S. Kids Golf World Championship in Pinehurst, NC.

 

CERTIFICATION OF CLOSED MEETING

 

A Resolution entitled, "A Resolution certifying a closed meeting of the Council of the City of Norfolk in accordance with the provisions of the Virginia Freedom of Information Act," was introduced in writing and read by its title.

 

ACTION: The Resolution as introduced was adopted, effective April 7, 2009.

C-1 Letter from the City Manager presenting recommendation of the City Planning Commission on the application of the City Planning Commission to amend the General Plan of Norfolk’s future land use map for property located west of Killam Avenue and north of 50th Street from Low Density Residential to High Density Residential.

 

ACTION: City Clerk authorized to advertise for a public hearing on April 28, 2009.

C-2 Letter from the City Manager presenting recommendation of the City Planning Commission on the application of the City Planning Commission to amend Section 6-0.3(a) of the Zoning Ordinance of the City of Norfolk, 1992, to correct an inconsistency in certain commercial districts regarding where residential uses may be located in a mixed use building and to establish minimum standards for such.

R-1 Letter from the City Manager and an Ordinance entitled, “An Ordinance to amend and reordain Ordinance No. 43,262, entitled, ‘An Ordinance permitting River House Apts., LLC to encroach into the rights-of-way of Llewellyn Avenue and Granby Street with a fence, fire water line, landscaping, and an irrigation system,’ adopted by the City Council on October 28, 2008 SO AS TO increase the maximum height of the fence from four feet to six feet,” was introduced in writing and read by its title.

R-3 Letter from the City Manager and an Ordinance entitled, “An Ordinance accepting and appropriating the sum of $62,620.00 from the Commonwealth of Virginia Department of Emergency Management to purchase equipment for the Norfolk Police Department’s Homeland Security Bomb Squad Unit,” was introduced in writing and read by its title.

R-4 Letter from the City Manager and an Ordinance entitled, “An Ordinance accepting with appreciation the donation of $6,110 to the City from the Norfolk Foundation and appropriating and authorizing the use of the funds to support services with a preference for the purchase of additional books, reading, or educational materials at the Pretlow Branch Library,” was introduced in writing and read by its title.

 

Ellis W. James, 2021 Kenlake Place, cautioned that the Library should have a back-up system in place.

R-5 Letter from the City Manager and a Resolution entitled, “A Resolution supporting the adoption of the Saving Our Children initiative and supporting the Youth Promise Act,” was introduced in writing and read by its title.

R-6 Letter from the City Manager and an Ordinance entitled, “An Ordinance approving agreements with the Commonwealth of Virginia, Department of Transportation, for the performance of various safety upgrades at the rail crossings located at Little Creek Road, Thole Street, and Norview Avenue; authorizing the City Manager to execute the agreements on behalf of the City of Norfolk; and authorizing the expenditure of the sum of $3,227.50 for these projects from funds heretofore appropriated,” was introduced in writing and read by its title.

 

Daniel Montague, 4605 Krick Street, supported this matter and commented about the need for an upgrade at the railroad crossing on Cape Henry Avenue.

R-7 Letter from the City Manager and an Ordinance entitled, “An Ordinance granting a Special Exception to permit the operation of an eating and drinking establishment on property located at 4300 Monarch Way,” was introduced in writing and read by its title.

 

The applicant, Qi Chen, 4300 Monarch Way, was present but did not speak.

 

ACTION: The Ordinance as introduced was adopted, effective April 7, 2009.

R-8 Letter from the City Manager and an Ordinance entitled, “An Ordinance accepting the dedication of a utility easement by the United States of America and approving the terms of the Deed of Easement,” was introduced in writing and read by its title.

NEW BUSINESS

 

1.      Gary Dubour, 1433 Kingston Avenue, commented about traffic on Ocean View Avenue, suggested using posts to separate lanes for tunnel.

 

2.      David Aument, 6400 Bridle Way, asked Council to close the cut-through on the pump house station side at 6231 Bridle Way to prevent criminals from using it as an escape route.

 

3.      Allan Zaleski, 112 College Place, echoed Mr. Aument’s comments and asked Council to close the cut-through at Bridle Way and Ventura Court.

 

4.      Danny Lee Ginn, 3844 Dare Circle, commented about city government.

 

5.      Ellis W. James, 2021 Kenlake Place, asked Council not to go forward with lifting the moratorium on uranium mining and advocated protecting our water resources from all threats.

 

6.      Merle Rutledge, 926 Wolcott Avenue, reserved his comments until the next meeting.

 

7.      Latonya Stanley, 514 Holloman Drive, Hampton, expressed concern about the treatment of her guests at Indra Lounge on Granby Street. Roslyn Askew and Diana Hawkes of Hampton were also present concerning Indra Lounge but did not speak.
